Business Consultations Can Answer Important Questions
Dean Law Firm immediately began researching the problems and unique issued faced by local businesses in the light of the stay-at-home orders. If your business has been affected at all by the stay-at-home orders and COVID-19, read how your insurance policy may cover business interruption. Business interruption claims are being categorically denied, as most policies have specific exclusionary language. You won't know, though, until you get a complete copy of the policy and consult with a knowledgeable attorney.
Businesses also need to take a look at other contracts for potential liability and "escape clauses." These clauses are typically referred to a "force majeure" clauses and allow for the cancellation of the contract if performance becomes impossible. Think about all the contracts you have - e.g. facility leases, equipment leases, contract workers, and outside vendors to name a few. If you are closed or your business is reduced due to the virus and stay-at-home orders, you may not be able to afford to continue to pay under these contracts. Likewise, other companies and person may not be able to perform their part on the contracts. Each contract is interpreted based on its own terms to determine whether you have a viable reason to cancel or not perform.
